Perry appeal confirmed

The Ontario Court of Appeal has received notice of Perry Dunlop's intent to appeal his civil contempt conviction, a court clerk confirmed Friday.

The clerk, who did not wish to be named, said the paperwork for an "inmate appeal" was filed yesterday morning, and that Dunlop does not have any formal representation at this time.

There had been some earlier concern that Dunlop's appeal would not make it to the courthouse in time to meet his 30-day deadline of April 5, as there had been some delays in both getting the papers to him, and then getting them out of the Toronto detention centre where he is currently being held.

"The deadline is linked with the date that the superintendent signs the document in the institution, which was within the 30 days," said the clerk.

"So even though we received it a couple of days after (the deadline), he did submit the documents to the superintendent on time."

The Ontario Divisional Court handed Dunlop a six-month jail sentence March 6 for refusing to testify at the Cornwall Public Inquiry in September and October 2007.

Helen Dunlop also confirmed her husband was launching an appeal, speaking to the Standard-Freeholder by telephone from her Duncan, B.C. home on Friday.

"We're just hoping for the best, at this point," she said when asked what she thought Perry's chances were for a successful appeal.

"I would hope that there's a bit of fairness left in the justice system, that some shred of light can come down from the powers that be."

Helen said she had spoken to her husband on Thursday, and that he seemed in good spirits, having heard that Cornwall police's former chief intelligence officer Claude Lortie had spoken favourably of him at the Cornwall Public Inquiry Thursday morning.

According to the appeals court clerk, the next step for Perry's appeal would be for the courts to process the file and make sure it included all proper documentation, at which point they would be able to set a date for proceedings.

Is there a reason he could not be placed under house arrest? There is not! Except that they still want to punish Perry, and they finally got it done.

This article had to pass through an Editor did it not prior to being actually publicized? Someone asleep at the switch? This is NOT responsible journalism.

Is this accurate? NO - Dunlop is not being currenty held at a Toronto detention centre.

Is it fair? NO - first name being used in the headline. (Is this reporter on first name basis with the Dunlops? If not -lack of respect shown. Is this how the Dunlops want to be addressed in the media? Anyone ask them?)

Is this balanced? NO - paraphrasing Helen Dunlops response.

Is this dealing with matters of Public Interest? Questionable - what's the relevance of what mood Perry Dunlop is in or what he supposedly thought of Lortie's testimony??

So much cover up in Cornwall that it makes me sick. I read in so many places where they caught priests, doctors and others sexually abusing patients and parishiners and they were imprisoned; but no not in Cornwall those people get away with everything. Perry Dunlop has risked everything to make it come forward. Cornwall's cops would never have exposed it nor investigated it. It would have gone on to be hidden and swept under the rug like it has for around a hundred years or more. Now we have seen where a little girl on Cumberland Street was murdered by a man in Cornwall but since this man is a poor man and not a doctor, a lawyer, an engineer, a priest and so on he has no leg to stand on. If he were the latter he would get off scott free and everything swept under the rug. It is not what you know but who you know and who you are in Cornwall.

Just make sure you take a screen shot - if you think things are disappearing. The Freeholder would never stand a chance with a responsible journalism defence in a defamation or libel suit - at least that's my opinion.

Dunlop is no hero, he's a conspiracy maker. We already know one of the accusers testified that he was cohersed, into signing a false affidavit by Dunlop and Chisolm. That's the REAL reason why he doesn't want to come here to the inquiry! He simply does not want it made to look like what he is, a conspiracy maker, who falsefies the truth to empower his case. Those of you who are reading this, please make sure you read who is posting at the bottom of every post. Some believe by making many postings, they are looking like they are a majority, lol. If Project Truth had been set up in any other city, you would have had just as many people coming forth with accusations(if not more), per capita, as Cornwall. I fully agree there is a problem, but the problem is not quarantined to the city of Cornwall. For those who are truly guilty of such a crime, I believe they should be HARSHLY sentenced!However, if Dunlop is such a heroic person, then let him finish what he started. He wondered why Lortie could speak so clearly about the meeting today, yet told a police investigator in 1994 that he couldn't recall any conversation with Dunlop and Murray MacDonald.

"I can't explain that," said Lortie. "I don't know why I would have said no (it didn't happen) because it's common knowledge we went to the Crown's office."

There is an obvious possible explanation: He lied.

Oh yes... there is a conspiracy. Although, perhaps not the one some are thinking of.

Responsible journalism I thought meant reporting the facts and that means ALL the facts and one would hope that they were accurate but as we ALL have seen in this Propoganda Rage called the Freeloader, accuracy is either a missnomer or just in the eyes of the beholder. A comment about post # 6 & #7 Let me get this straight (JackJames) 1 guy recants his story so Perry Dunlop is a liar. Could it at all be possible that the one that recanted has been bought out. So all the other witnesses are liars right. You can keep sticking your head in the sand and hope this will all go away (JackJames) but it will not. Better pray to god that an officer like Perry Dunlop is around in case one of your children or grandchildren are ever preyed on by a pedophile.

RESPONSIBLE JOURNALISM encompasses all four.

Reporters are responsible for the accuracy of their work. Editors are responsible for confirming the accuracy of the stories before publication and must know in detail the documents to support the stories and the reliability of the sources. I understand the Editor of the Freeholder teaches journalism at the College in Cornwall. You would think he's been teaching these young reporters good journalistic principles and ethics. Doesn't appear so. I also understand the Editor of the Freeholder has never been seen within the walls of where the Inquiry is and where alot of documentation would be...so you tell me - any accountability at the Freeholder in what is going to print?

Well, realitychecker, I agree with you about your view on journalism, I think your point, on good journalism, is well made. However, I don't know that, IF the editor never went to the inquiry, is really that relevant. Many editors, usually only edits the reporters story, believing their reporters are competent. If they are competent or not, that I would not know.

JackJames I happen to work for a living and don't just sit at my pc all day waiting for someone to reply. I have two grandchildren that were molested and guess what one of the pedophiles got as punishment. 6 damn months of house arrest. The other pedophile died before he got to trial. by the way not one pedophile of importance was ever convicted nor was it for lack of evidence the cases were thrown out because too long to get to trial which does not mean they are not guilty just means it took too long. Heck Malcolm Macdonald a former crown attorney got off with a complete discharge even though he was found guilty of the crime he committed. Dodger, I'm very sorry for what you went though and are now going through. I cannot even fathom how you are feeling, though I have somewhat of an Idea. I did not mean to condesend, sometimes print doen't relay true sentiments. I was trying to lighten the mood, I figured you had things to do, as I also had. If I had any knowledge of what you have been through, I would have been more careful not to offend. I can undersatnd your hostility about all this, of course, not fully. No one, I think, can truly understand unless they were made to go through what you went through with your family. I appologize for any hurt sentiment that I might have caused you. I simp[ly would really like this inquiry to have the full truth come out and I am a disapointed that Mr. Dunlop won't testify. If he did, we might have a better solution to the problem at hand at the end. It might help all who have those who have been injured to have some kind of closure.

I also have been approached by a pedophile a long time ago, when was 18. Nobody would believe me, until a friend of mine's parents made sure the church listened to their son, who was abused by this priest, who was a chaplain at our high school. He plead Guilty in '86 for it. Got nothing for it, but 2 yrs. probation.

I think our community would benifit from having all said and done, so that the inquiry can, hopefully, reach a sollution to this problem.
Again, I am truly sorry for what you and your family have been through.
